Legal Framework

19 USC 1321 — De Minimis Threshold

US law exempts shipments valued at $800 or less from formal customs entry requirements and duty collection. The threshold was raised from $200 to $800 by the Trade Facilitation and Trade Enforcement Act of 2015 (TFTEA). This provision enables the modern cross-border e-commerce model where individual consumer packages enter duty-free while still receiving CBP oversight through electronic data submission.

Type 86 — Structured De Minimis Filing

Type 86 is the electronic entry type CBP created specifically for high-volume de minimis shipments. Unlike informal entries, Type 86 requires 10-digit HTS classification and PGA screening data, giving CBP the targeting information it needs without requiring formal entry summary (7501) filing or duty payment. This is how platforms like Temu, Shein, and Amazon move millions of packages through US customs daily.

Eligibility & PGA Screening

Each shipment is checked against Section 321 eligibility rules. Products subject to antidumping/countervailing duties, Section 301 exclusions, or IEEPA restrictions may not qualify even under $800. Simultaneously, all 16 PGA agencies are screened — FDA food items still need prior notice, CPSC-regulated goods still need compliance, regardless of value.

Type 86 Entry Filed

Qualifying shipments are filed as Type 86 entries through CBP ACE. Each entry includes the 10-digit HTS code, PGA screening results, and shipper/consignee data that CBP requires for targeting. The filing happens at edge speed — entries are transmitted within seconds of manifest submission.
